CALLING which takes place in order to deal with the points of the ORDER OF THE DAY

 

D. José Schwartz opens and thanks those present for coming.

 

FIRST: Resume of the agreements of the previous general meeting.

 

Mr Antonio Serrano, president of block one, takes the stand and makes a summary of the previous act.

The Act for the previous general meeting is passed,

 

SECOND: Report on the accounts.

 

Mr. Jose Shwartz, president of block 3, explains that the accounts from July of last year are being presented as our fiscal year goes from 01/07 to 30/06 of each year.

The summary is that we have spent a lot of money due to the work that has been done on the kitchens and little by little we are recovering.

The main expenses are electricity, water, gas, personal, cleaning of apartments, tableware (see annex 1)

The communal quotas which we pay in every year is a significant amount, some 265,000€, occupation expenses 67,000€per year, rental of store roomsetc.. these things help us continue making investments.

Now we are going to do in detail the costs of each part of the building work in blocks 1&2.

All these parts are paid and the Money has left the extra quotas and the community quotas, now we will explain how each part has been paid for.

La community has to pay a total of    90.244,19€.

 

 

From the extra ordinary quotas for the kitchen , we have received almost 100% of the expected first quota and for the second one there is about 20% still to be collected..

The calculation that has been done , is that 70%will be paid since the remaining 30% are periods which do not have owners.

 

Ms Unga Kampman asks if there are any Danes who have not paid and she is answered that yes there are Danes, English and Spaniards.When these owners come to occupy the apartments they will have to pay their quota, if not, they will not be able to enjoy the use of the apartment.

 

Mr. Benny Schkolnik asks if when the apartments are sold the price of the quotas of the kitchen are included. He is told that yes they are, that the community is recovering old debt of common quotas, extra quotas from bathroomsand kitchens from block3,

Mr. Knud Nielsen asks if there are owners who have not paid the bathroom quota and they use the apartments, he is anwered that no, they do not, that they are periods which are abandonned and the recovery of the debt is due to the fact that the administration of the community have rented the said period..

Also part of the recovery is from judicial sentencing. Every year a list of debtors is approved so that they can be taken to court and the debt reclaimed.

 

THIRD; report of the legal situation.

 

 Mr. Víctor Fernández, president of block 2 speaks, explaining that we are waiting for the final adjudication for the periods of blocks 1 & 2 , in which the community will become the owner of the said periods, which can then be sold in the same conditions as is being done with block 3. The first option of purchase will be given to owners who have right of use and if the said owners do not wish to legalize these periods any other person can buy them. The price of sale is what it has cost the community all of the judicial process, lawyers, solicitors etc  

Ms. Inge Kampmann asks if there is a difference in the process with Spanish and foreign debtors. She is answered that at the moment we are talking about the companies which built the blocks which are Spanish, but in the process of individual owners, that yes there is a difference since it is almost impossible to find foreign debtors.

Mr. Alex Karlsson says that he would like to sort out the paperwork of his apartment, “can he do it if various owners with the same problem get together? He is answered that if the owner who is inscribed in the registry for the apartment has died it is almost impossible to be able to change the deeds as there is no one who can sign the new ones before the notary, but if it is a period in which the period is registered to the building company, when the community has got the property it could sign the deed.

 

FOURTH: Study and approval if it procedes of the list of non-paying owners to the effect established in the art 21 of the Horizontal Property law and presentation of the action to be taken.

FIFTH: Report on actions taken and those to be carried out.

 

Mr. José Schwartz reads the list of things carried out this year

 

n       The kithcens in blocks  1& 2. Have been fixed.

n       WIFI connections have been installed in all the apartments

n       LED light bulbs are being put into the apartments

n       The little walls on the balconies which are in bad condition are being repaired

n       THe sofá legs have been repaired    

n       Pullies have been bought for the awnings so that the broken ones can be replaced.

n       A roof  has been installed for the bicycle park in block 3

n       The wáter meters have been changed in block 1&2 to gain more pressure,

n       Scandinavian channels have been installed

n       Security cameras have been installed in the three main doors.

The following things are planned to be done:

n       Instation of a desfibrillator in blocks 2 & 3

n       Security safe box in the apartments

n       Get toasters, blenders and kettles for the apartments

n       Instalación de ventiladores de techo en los  salones y dormitorios de los apartamentos.

n       Instalation of sports equipment

n       Stools for the kitchens in all the apartments.

 

All of these things will be done as and when the community can cover the costs

 

Sixth: quieries and questions

 

A round of questions is opened

Mr. José Schwartz, president of block 3, wants to start the round of questions commenting that in the meeting that the governing body had this morning , they have been studying the electricity bill which so far this year has gone up 22% and it is foreseen to increase even more.

The occupancy charges, 3.50€ which are paid for the consumption of water, gas and electricity have not gone up in over 10 years and so therefore it is proposed that it is put up by 0.50centsper day, that is to say 4.00€ per day. This increase will be applied as from 1st January 2018

On the other hand he comments that a lot of money is being invested in maintenance and furniture and furnishings in the blocks which is why he asks that if there are any families which are away for any time periods if they could not leave things like mattresses, cushions, sofas etc on the terrace as they deteriorate due to the humidity, sun and rain.

And finally he reminds everyone that if you break it you pay for it. An inventory of each apartment is going to be put in the kitchen drawers, normal wear and tear will not be charged but acts of vandalism will be.

 

 

Mr. Stephen Schramm asks why the rubbish bins are not next to the swimming pool. He is answered that they want to avoid the bad image that is given if owners have to pass by the pool in order to deposit rubbish. It is explained that from19h till 8h every day the bins are in the street, next to the restaurant Antiguo Mesón , and during the day the bins can be found next to the bike parking of block 1. During offices hours in the office you can ask them to open the gate of block 2 if it were closed in order to deposit rubbish. It is clarified that that the said gate is open all morning and there is free access to the bins.

Mr. Camacho, asks if the security safe boxes have been bought yet. He is told that they are getting quotes. He says he has a contact who could give us a good price so he is asked get in touch with admin so that they can tell him characteristics so he can get us a quote.

Mr. Antonio Serrano, president of block1 would like it to be known that it Winter the apartments need to be comfortable so it is necessary to use a heater but please use responsibily. Therefore he asks that when apartments are left for hours that the heaters are not left on as this is an unnecessary use of  electricity and also that it is  a fire hazard if a heater is left unattended

M .Julius Nielsen , asks if solar panals have ever been considered. He is answered that in Spain this is a delicate matter as upto now it is necessary to pay a tax for the said panals.

He also asks that the community makes a list of all the things that can be lent.

He comments that he asked the office for a list of all the emails of the owners of his apartment but he was denied it. It is explained that it is not possible due to the Spanish protection of private information law.

 

Mr. Ole  Sorensen, asks why the terrace of block1 is closed. He is told that in office hours you can ask for the key, but is not wanted to be left unattended to avoid noise and conflicts between neighbours. Remember this space cannot be used for BBQ.

 

Mr. Ejnar Harring, comments that they install electricity meters in each apartment and that everybody pays their own consumption and he is told that each apartment has a meter but it is very difficult to estimateeach period and divide the fixed expenses which are paid even if there is no consumption. It is reminded that some years ago it was agreed that the apartment that has excessive consumption would pay the difference.

Item #1: Reading and approval of the previous minutes.

 

Mr. Antonio Serrano Molina made use of his turn to speak and read out loud a summary of the reached agreements and most important items from the previous general assembly. It was adopted unanimously.

 

Item #2: Presentation and approval of the accounts and balance sheet for the financial year 2015/16.

 

Mr. José Schwartz takes the word and begins by explaining that due to the kitchen reform, the balance of the communitys accounts has diminished considerably, but that the balance will begin to recover in the summer months.

 

Mr. Camacho asked if it is still only 50% of the community members that continue to pay; he was replied that the current trend is upward, since the community is gradually gaining more homeowners, as many assignees are becoming owners and new families are also buying periods.

 

A paper with the treasury position for the accounting year was distributed and was shown on overhead projector (Annex 1).

Mr. José Schwartz explained amongst the different items that, for example, the revenue from the storage rooms was € 15,000, which has been the result of the investments made by the community in these storage rooms to clean them up and they are now yielding benefits.

 

In the coming year, the community will invest in the installation of Scandinavian television as the foreigners have requested it, but this will be a paid service, so that the investment will be recovered.

The administration continues to recover payments of ordinary quotes and extraordinary quotes  from previous years.

 

 

Item #3: Information about actions/initiatives undertaken during the year 2015/16

 

Mr. José Schwarz explained that this year the community has been busy with the renovation of the kitchens in blocks 1 and 2, which has been going on from October to the end of May.  An overview of the expenditures is shown:

The table shows in details the different items paid by the extra kitchen quotes and the community respectively.

 

Mr. Cipriano Marín said that block 3 has been prejudiced, as block 3 had to borrow money from block 1 and 2 to be able to do the kitchen reforms.

 

Mr. José Schwartz explained that this was not the case, since when block 3 needed money to finish the kitchen reform, the community lent it to block 3.  Mr. Schwartz also wanted to clarify that this is a joint community and that the accounts are joint and everything is done in common. This is also shown in the financial statements where all figures are for the 3 blocks and not for each block. The Board intends to continue in this line as we are one community.

 

Apart from this, the community has enhanced the following improvements:

 

A WIFI network has been established in all apartments.

LED bulbs are being installed in the apartments.

The barriers in disrepair on the balconies are being repaired.

The sofa legs in poor condition have been fixed.

New awning pulleys to replace those in a bad condition have been purchased.

Installation of a sliding roof to cover the bicycle parking in Block 3.

The water meters in Blocks 1 and 2 have been replaced to give more water pressure.

 

Item #4: Report of the legal situation.

 

The greatest progress, we have had at this point, is from the Property Registration office in Almuñecar, who have found the solution for the legal registration of the periods which were awarded judicially and currently are being sold by the community to third parties.

Today, we continue to sell the periods that were awarded to us in block 3 and out of the 79 periods awarded, 33 have been sold, 11 are reserved and 30 are still free to be sold.

 

On the other hand we are still waiting to be awarded the periods in block 1 and 2. We have recently requested the court to accept the appraisal we did for block 3, in which case we would save 5,000 €.

 

It is stated that the law on vacation rental has changed this year and owners must know about this. The community is making efforts to get information about these changes and will inform the owners when this information is ready.

Mr. Cipriano Marín informs that he is managing it personally but as the periods are on fortnight or monthly basis, the Granada delegation has not given any solution and has passed the case on to Sevilla to see if they can solve it.

 

Mr. Camacho asks how many apartments the community has been awarded. The total number of apartments were 10, of which 79 periods (fortnights) were obtained.

 

Mr. Cipriano Marín asked about the efforts to register the premises of block 3 on behalf of the community. Mr. José Schwartz said that the problem is that the premises are seized by a bank, but the community is still trying to legalize the situation. We have the same situation with the corridor between the premises. This corridor belongs to the community but the premises have appropriated it.

 

Item #5:    Study and approval of further measures under Article 21 of the Condominium Law  (Propiedad Horizontal - Owner Association Law) and presentation of the measures that can be taken.

 

A list of defaulters is projected. It was adopted unanimously (annex 2).

 

Item #6 : Presentation and approval of outstanding actions.

 

The Community wants to carry out the following actions in the coming year.

 

- Video surveillance in all portals: cost € 1.355,20

 

- Defibrillators in Block 1 and Block 3, cost € 3802.98

 

- Installation of leisure and sports facilities, cost € 3.000,00

 

- Safes for all the apartments, cost € 7.560,00

 

- Scandinavian Television, cost € 3.000,00

 

- Toasters for all apartments, cost € 1.890,00

 

- Mixers for all apartments, cost € 2.520,00

 

- Water heaters, cost € 2.142,00

 

The first thing to be installed this year is the video surveillance. There will be installed anti-vandal cameras in the doorways, controlling the entrance and the exit to the elevators and the blocks.

 

Hereafter follows the installation of two defibrillators at different portals. One will be installed with instructions in Spanish and one with instructions in English. This is highly demanded by the winter owners as many are elderly.

 

Mrs. Mercedes Navarro asks: What sport facilities have to be installed? Mr. José Schwartz explains that it will be difficult to install any of those facilities this year, but the idea is to install various machines such as those installed on the beaches, on the left side of the garden where once the septic tank was.

 

The community also wants to provide safety deposit boxes  to the apartments. This will be an investment where the community will recover the expenses, as it will be a paid service.

 

This winter, the installation of Scandinavian television will be fulfilled. This service is highly demanded and will also be a paid service.

 

Mr. José Schwartz tells Mr. Cipriano Marín that the board has taken into account the proposal to put ceiling fans in the living room and the bedroom. The board are currently looking at budgets and possible dates for the installation.

 

It is also commented to the attendees that the board are looking for stools to be put in the kitchen, since not everyone can reach the top of the cabinets.

 

 

Item #7 : Renewal and re-election of the Board.

 

As every year, candidates for the post as president and vice president of each block were requested.

As there were no new candidates, the current presidents and vice presidents were re-elected.

Item #8: Questions and miscellaneous.

 

Mr. Cipriano Marín insists on having on the records that the expenses and revenues should be allocated as stated in the statutes of the community.

 

Mr. José Schwartz wants to acknowledge that the Governing Board, after a morning meeting, has agreed that any damage to the apartments by misuse is the owners responsibility, whether it has been coursed by the owner himself or any of his/hers tenants.

 

Mr. Antonio Serrano wishes to emphasize that the maximum number of occupants in the apartments are 5 people.

 

Mr. Francisco Diaz asks: How do we control it? Mr. Antonio Serrano answers that he still doesn´t have an exact way to control it but that the board are looking at different options to carry out in the near future.

 

Mr. José Schwartz says that for next year there will be made bracelets, which will be handed out when people collect their keys at the administration office. These bracelets are for the use of the swimming pool, and a maximum of 5 bracelets will be given to each apartment, to see if we gradually can control the occupation.

 

As there were no further matters, the meeting was closed and ended at 18.55 pm, the 23th of July and I, the Secretary took one set of minutes of the general assembly held in Almuñecar.

Almuñécar får status som turist kommune

Det betyder, at byen kan søge om tilskud til at forbedre service og infrastruktur.
 
Ved et møde i kabinettet i den regionale regering i denne uge godkendtes det at yde Almuñécar status som turist kommune, som den første by i Granada-provinsen og som den sekstende i Andalusien.

Denne status bringer en række fordele med sig, herunder retten til at ansøge om tilskud til fremme af byen og forbedring af infrastrukturen og kvaliteten af  tilgængelige tjenester. 

Nogle af de krav for at blive betragtet som en turist kommune er, at en by skal have en befolkning på over 5.000 og under 100.000 og at i mindst 30 dage om året skal antallet af besøgende i byen være mindst fem gange højere end den registrerede lokale befolkning.

Det har taget Almuñécar otte år at nå til dette punkt. Byens borgmester, Juan Carlos Benavides, sagde efter at have hørt nyheden: "Vi føler os meget tilfredse med at have opnået dette og selvom vi beklager den tid det har taget er alt godt, der ender godt ”.
